NYC Media Arts Playing Cards (“we,” “us,” “our”) operates the website at nycmediaarts.org from Melbourne, Victoria, Australia. These Terms of Service govern your access to and use of our website, online store, user accounts, and related services. Nothing in these Terms is intended to exclude, restrict, or modify any rights you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law, “ACL”) that cannot lawfully be excluded.

By accessing our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, you must not use the website or purchase from us.

Products & Descriptions

We offer collectible, design-forward, and premium playing cards. We aim to describe items clearly, including edition details and imagery that fairly represents the goods. Display colours may vary depending on your device. If you are a consumer under the ACL and a product fails to match a description, you may have statutory remedies; see our Returns & Refunds Policy.

Orders & Acceptance

Placing an order constitutes an offer to purchase. We may accept or decline all or part of an order. A contract is formed when we confirm acceptance by email or by dispatching the goods. If we cancel an order after payment, we will refund amounts paid using the original payment method.

Pricing (AUD)

All prices are in Australian Dollars (AUD). Prices include GST where applicable. We use reasonable efforts to ensure pricing accuracy; manifest errors may result in order cancellation with a full refund. Shipping is quoted separately at checkout.

Intellectual Property

Website content is owned by or licensed to NYC Media Arts Playing Cards and protected under Australian and international intellectual property laws, including the Copyright Act 1968 (Cth) and the Trade Marks Act 1995 (Cth). Subject to the above, our total liability is limited to the amount you paid us for the specific goods or services giving rise to the claim in the twelve (12) months before the claim arose. To the extent permitted by law, we are not liable for indirect, consequential, special, or punitive loss.

Indemnification

You agree to indemnify and hold harmless NYC Media Arts Playing Cards from claims arising out of your breach of these Terms, misuse of the website, or violation of law, except to the extent caused by our wrongful act or where indemnity is prohibited by law.

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the Federal Court of Australia sitting in Victoria.

Severability

If any part of these Terms is invalid or unenforceable, that part will be read down or severed, and the remainder will remain in effect.

Changes to Terms

We may update these Terms from time to time. The “Last Updated” date will change when we do. Continued use after the effective date constitutes acceptance of the revised Terms.
